This is the Terms of Service (TOS or T.O.S) for myself (Taylor Elaine Art) as the artist. This is to be read thoroughly by you, the commissioner, before deciding to work with me. If you choose not to read the TOS, and still proceed with commissioning me, you hereby agree to my entire TOS automatically.Understand that it is your responsibility to be vigilant about reading my TOS as I may make minor updates without notice, I will however make updates for major updates. Please note that you are subjecting your characters to my artstyle, so there may be variations in color or design. However I will do my absolute best to keep your character true to form.

The Process

My Work Schedule:
I work on Commissions Monday-Thursday.
Friday-Sunday are flexible art and/or rest days.1.) I will open for commissions through "Your Character Here" or by opening a pre-determined amount of slots through an Announcement on Twitter. To keep myself from getting over loaded with work, I will only accept four commissions at a time. If all four slots are filled, you are welcome to ask and I will add you to my queue for the following commission opening.2.) When your commission is accepted, I will send an invoice to you via PayPal or Square. PayPal and Square are strictly used and there is no other form of payment at this time. USD payment only. Payment must be sent within 24 hours.3.) Once payment has been sent and accepted, the commission will be placed on my queue of which you can view on my Trello, linked on the front page of my Carrd. Estimated time for finishing art varies, but an average piece is usually finished within 1-3 months. This gives me time to effectively work on your piece and give you the best result possible. I believe in frequent communication and updates. You will not be left in the dark.4.) I do have the right to refuse a commission or client for any reason whatsoever. I absolutely will not accept payment from blank accounts (accounts that haven't been used).5.) I will not accept any commission from anyone under the age of 18, I will ONLY accept commissions from people 18 and older. This also includes that I will not accept a commission from someone being payed by a minor to commission me. For example, if you’re under the age of 18, you cannot pay someone else to pay me for artwork for you.6.) I will provide Sketch WIP’s and the Linework to the Client before I complete the artwork. Changes may be made in the sketch stage, after that there are no major changes at that point. Minor changes are acceptable only in the linework stage after sketch approval.7.) I request that an updated reference sheet of the commissioners’ character is provided. I will only accept a digital, non shaded, updated reference sheet, not 3-D models, not traditional art format. NSFW refs are NOT acceptable since I mostly draw feral creatures. If you do not have a reference sheet that meets these requirements I will decline your commission.

Payment

1.) Payment is in full and upfront within 24 hours unless otherwise specified. Payment plans are not offered unless myself and the client have discussed otherwise. I only accept USD (United States Dollars) through PayPal or Square.2.) I will NOT accept any other form of currency including but not limited to Crypto-Currency/NFT's. If you try and send Crypto-Currency to me as a form of payment you will be blocked and blacklisted from my art. NO mailed cash! NO electronic checks!3.) Once payment is sent and accepted, no FULL refunds will be given past the 24 hour mark. After that, refunds will be given based upon my status of completion on the art piece. See the refund section of my TOS for further details.

This section is for you, the client, to see what content I'm comfortable with drawing. Feel free to contact me with any questions or concerns.What I Will Draw:

(These are the subjects I refuse to draw under any circumstance. Feel free to ask if you have any questions.)

Adoptable(s)

1.) Adoptables are offered through auction or through custom commission. Each adoptable I make will be made through original lines and design every time, I will not use a base.2.) Custom adoptables are the only acceptation for written character description, however keep in mind that these are subject to artistic freedom as well. But I will always ask if the commissioner likes or dislikes it and will change accordingly to suit the client's liking.3.) Mood boards or aesthetic pictures are the BEST way for me to get an idea of the character you want me to create.4.) Once the auctioned adoptable is sold, payment is expected upfront and within 24 hours. See
Payment section in my TOS for all accepted payment methods and payment location.5.) Once payment is sent and accepted the owner gets the file, character rights and they may repost wherever. If they wish to resell that's fine, but you may not resell the adoptable for more than what you bought it for. Unless you've accumulated more art for the adopted design in which case you may make a new price added to what you've bought for that design.6.) You may change the name and/or gender of the design. Small changes to the design are fine as long as the overall design is still the same.Violations to any of these rules mean I will reclaim the design and the violator will be blacklisted from my adoptables/artwork.

Refunds

1.) I will only give a full refund if I cannot preform the commission and the problem is on my end. Once payment is sent and received within 24 hours and I've started the commission, there will be no full refunds.2.) I have the right to, at any time, drop a commission if the commissioner is being rude, impatient, or hard to deal with in anyway. If this happens, I will give the commissioner partial refund. I reserve the right to use whatever I created for that commission for myself or whatever else I so choose if the commissioner does not want/or accept whatever amount of art would be returned after a partial refund.3.) Once payment is sent and accepted, no full refunds will be given past a 24 hour mark. After that, refunds will be given based upon my status of completion on the art piece. For example, if for whatever reason past 24 hours after I’ve started the art piece and the commissioner requests a refund, I will issue a refund for what I haven’t completed and give the commissioner what was completed. For example if the commissioner initially paid for a fully shaded picture, and asks for a refund some time after I’ve already started the piece, such as if I’ve already lined their commissioned piece, I would consider this a lined commission. I would issue back the difference and keep whatever profit would’ve been given if they commissioned for a lined piece to begin with.

Auctions

Follow whatever Auction rules I've here and/or on the Auction post I created.1.) Do not retract or hide your bid, if you do and then do not communicate with me about it you will be blacklisted from future auctions or commissions. So please be confident when you bid that you’re able to fulfill the payment offered.2.) Do not cause problems with other bidders or myself.3.) Full payment is expected upfront and within 24 hours via Paypal invoice.4.) No payment plans unless otherwise discussed with me, all payment is upfront and in full.

Usage

1.) Only people who have commissioned my art may repost it.2.) No editing the original file of my art, ask me about small edits. (Not all edits will be accepted, and some edits may be charged).3.) Do not redistribute my art. Do not blatantly copy/steal my art. My artwork is copyright to me, and may not be claimed in any other way.4.) I am to be credited when my artwork is uploaded by a commissioner.5.) My artwork/designs are not to be used for commercial use, NFT's, AI "art" or anything of the like.6.) I am allowed at anytime to sell prints of any of my artwork.7.) I reserve the right to reuse any lines or aspects of my own artwork in repeat situations such as for my own personal art if I so choose.8.) Please save your commission. I am liable to delete files, and I am not responsible for keeping up with commissioners and their pictures after I’ve completed them. So please do your best to save your picture so you don't lose it.Violations of these rules will have you included on my blacklist.

Conclusion

By commissioning me in any way you have agreed to reading these rules and regulations, including if you've not read through my TOS. Violations of any of these rules will have you included on my blacklist.
